BAY MINETTE, Ala. - "He's a grown man and should know better," said a mother, speaking out for her daughter. Police said just months ago, in January, the 15-year-old and pro football player Anthony Mix had consensual sex. Investigators said the incident started by text messaging.

"One thing led to another and they decided to meet up. We believe he was aware of the age of the girl. She snuck out of her house, they met, they had sex in the vehicle while it was parked on the street," said Sgt. Lester Banfield with Bay Minette Police.

Police said the two did have sex a second time and the girl was brought home around 3:00 a.m. Later that morning the girl's mother found out and a police report was filed.

"Through the investigation we decided we had enough evidence to take the case to the grand jury. We presented the case and they came back with the indictment for contributing to the delinquency of a minor," Banfield said.

Bay Minette Police said along with the delinquency of a minor charge they were also pursuing two other charges, second degree rape and sodomy, but the grand jury decided only to indict Mix on the misdemeanor.

The mother of the victim said her daughter hasn't been the same since. "She's going through alot, she doesn't want to face it," said her mother.

She said she wanted her voice to be heard. "I don't like the idea of what he did, it's not fair for kids to have to go through stuff like this. Plus he has people looking up to him. It's just not fair," said the victim's mother.

Mix has not been in contact with the authorities and they believe he is not in the Bay Minette area. Police believe Mix is in the Tampa area. Because the charge is a misdemeanor, police said Mix probably won't be arrested by another police department and extradited, so investigators will either wait for him to turn himself in or arrest him when he comes back to Bay Minette.

Mix faces up to 12 months in jail and up to a $500 fine if convicted.
