The last thing you feel like doing after an accident is dealing with insurance companies, but it's something you have to do. Attorney David Greene from Greene & Phillips says when someone has been injured in an auto accident, the wrongful party’s insurance will do what they can to limit their liability to the injured party. They’ll often send someone to the scene to take photos and get statements from witnesses. They’ll often try to get the injured party to to make a statement that could jeopardize the case.
If you are in an accident, the other driver's insurance company will contact you. Greene says you should remember that Alabama is a contributory negligence state so if they can get you to claim even partial responsibility they are not required to give you anything for the accident. That’s why it’s best to say nothing.
Greene also says it's usually not a good idea to accept the insurance company's first offer because they will attempt to pay you as little as possible. He says many times you will get a much larger settlement if you hire a lawyer.
