McGuire's Irish Pub is in a battle over the bathroom signage

PENSACOLA - McGuire's Irish Pub is known for its crazy antics. Right now, it's in a battle over the bathroom. In April, a 15 year old girl was in the restroom at the Destin McGuire's when a male customer accidentally walked into the ladies room. Her dad filed a complaint to the Florida Department of Business and Professional Regulation. The Destin McGuire's had to take its signs down. Pensacola is next.

Customers say, "I've been coming here 10 years and we've since little kids, it's not a big deal, if they read it, they'll see it, right bathroom but you need to read the sign".

While we were there, we saw a few guys accidentally go into the ladies room. They didn't realize it until they were in there for a couple of minutes. They took all as a good joke.

Jordan Picchiottino says, " It's the funniest thing that's ever happened to me".

So legally, is McGuire's allowed to keep the signs up? The law says bathroom signs need to be properly designated but an attorney with whom we spoke says the law is unconstitutionally vague. He believes McGuire's shouldn't be subject to it unless all restaurants are.

Attorney Scott Remington says, "Depending on where you go, it either says inboard, outboard, buoys, gulls, Mexican restaurants say hombres and Mamacitas, what is properly designated, no one really knows."

People are signing a petition in support of the signs. The Destin McGuire's already has 7,000 signatures. McGuire's lawyer tells us, he recommends they keep the signs up, but he has no idea what the restaurant will do.

The Florida Department of Business and Professional Regulation has given McGuire's until Tuesday to get rid of the signs.
