MOBILE, Alabama (WALA) - For the fourth time in a row, Felicia Lee has been denied bond. She's the mother of capital murder suspect Michael Lee, who was arrested in the Kyser Miree case.
Felicia's family said bond being denied again isn't fair, and attorney Sid Harrell said it's unconstitutional. He plans to ask for bond a fifth time.
Lee sat quietly as Judge Robert Smith denied her bond. Lee is accused of threatening to kill the key witness in her son's murder case.
"This woman, they're accusing her of making threats and won't let her have bond. You have murderers who are out on the streets, walking the streets accused of murder. And they won't give her bond," said Constance Mims, Lee's aunt.
The district attorney's office called Lee dangerous. Assistant District Attorney Jill Phillips said Lee produced a gun, and threatened to "shoot up" the witness's home. Phillips also referenced other cases of vandalism and harassment.
"As far as intimidating this witness, just this one victim that she has the two charges for. There have been complaints by other people involved in case. The instances are all being investigated," said Phillips.
Phillips wouldn't say who those other people are, but did say since Felicia Lee has been locked up, the complaints have stopped.
Harrell said he isn't giving up. He believes his client's constitutional rights have been ignored. Judge Smith said Lee forfeited her rights.
"My argument is constitutional. You're given a bond. How could she forfeit rights? They're saying she is guilty of conduct she hasn't been to trial on," said Harrell.
The state said this isn't the first time Lee has been accused of harassment. Two decades ago, she was charged with harassing phone calls and criminal trespassing.
Still, her family cries foul.
"It's not in her nature, this isn't fair," said Mims.
Lee's case has been bound over to a grand jury. Michael Lee's case has also been bound over to a grand jury.
Michael was named the shooter in the murder Kyser Miree. Miree was found shot to death in his midtown home back in April.
Michael Lee and three others, Bo Taylor, Earnest Wiggins and Jamal Lang, face the death penalty if convicted.
