New details revealed on Derrick Myles

MOBILE, Alabama (WALA) - Fox Ten News has learned that Derrick Myles's smash and grab charge from 2009 was dropped because the office involved in the arrest was nowhere to be found when the case went to a grand jury.

According to the district attorney's office, Myles was never indicted for the smash and grab in 2009 which he was caught in the act of doing. Myles was arrested the same day and charged with stealing a black Jeep Cherokee and using it to try and make off with an ATM.

So why couldn't the grand jury send Myles to trial?

According to court records, the officer involved in the arrest in the case did not come to court when he was subpoenaed. In fact, the courts were unable to locate the officer. The officer left the Mobile Police Department and law enforcement all together.

Without evidence or testimony from the officer, the grand jury wasn't able to indict Myles, meaning the case was over and he walked away free.

Even though the 2009 smash and grab case was over, a Mobile judge still had jurisdiction over Myles because he owed the courts more than $8,100. Court records show Myles came to court several times and couldn't pay the money and the judge ordered him to 20 hours of community service and told him he had to get a job each time.

Records show he applied to work at a Dollar General, but never paid the court costs.

Myles is due in court on the September 30, 2010, to face those fines again.

When authorities capture Myles he will have a lot more to answer to than just court costs.

Anyone who knows where Myles is hiding or if you are hiding him from police, do the right thing and turn him in. Anyone who is caught helping Myles hide from police can be charged with harboring a fugitive.
