MOBILE, Ala. (WALA) - Kendall Howard, a 16-year-old who has been charged with attempted murder, was denied bond in court Tuesday morning.
The Mobile County District Attorney's Office says Howard was out on bond for robbery and assault charges when police say he shot another teen on Alethea Drive. They requested he stay in metro jail without bond.
Howard was initially charged with first degree assault, but that charge was upgraded Monday .
"Certainly given the other charge that was pending and the violent nature of that we felt like he was a danger to the community at large," said Assistant District Attorney Jill Phillips.
Judge George Hardesty granted the DA's request.
Howard's attorney, Christine Hernandez may try again to get her client released on bond.
"I'm not disappointed in what happened today we had an arraignment set for Monday we can revisit bond at the time," said Hernandez.
Hernandez says Howard will plead not guilty at his arraignment hearing July 16. His mother told persists that he was protecting himself when he shot the victim.
"My son, Kendall Howard, the one who is arrested for the shooting, was the victim in the shooting," said Howard's mother.
Howard's lawyer said "I cannot comment on anything that his family told you. I wasn't present, didn't hear it."
The victim is still in Providence Hospital in critical but stable condition. The victim's family said he'll have to go through physical therapy and will have to learn to walk again.
