Bond set at $200K for teens in felony murder case

BAY MINETTE, Ala. (WALA) - Baldwin County Judge James Reid set bond Friday, November 30 for the three teens charged with felony murder in the shooting death of Summer Moody.

Bond was set at $200,000 for Scott Byrd, Dylan Tyree and Daniel Parnell. The Baldwin County Sheriff's Office and district attorney’s office asked for a higher bond.

“We have a concern as to whether they think they should stick around and face charges. I would have appreciated and we all would have felt much better had any of these three young men realized and recognized their causing this death," said Distirct Attorney Hallie Dixon.

The teens also face second and third degree burglary charges in the Gravine Island case.

Byrd's new attorney Pascal Bruijn said he believes a jury will disagree.

"I cannot wait to get in front of a jury with these facts," said Bruijn. "It is unforeseeable to our client that their friend would be shot."

Dixon said it doesn't matter who fired the shot.

She said the teens went onto the island to commit a felony and in the course of that felony Moody was shot.

"The fact that the bullet that caused her death was not intended to strike her is the one reason it fits felony murder. Because felony murder requires unintentional killing during a dangerous felony," said Dixon.

Also, Clark Stankoski, who formerly represented Scott Byrd, said now that murder charges have been brought against the teen he can no longer represent him due to a conflict of interest.

Stankoski’s brother, Robert Stankoski, is representing the Moody family in their civil case.

Summer Moody died in April. When she went with the three boys to Gravine Island where authorities said they believe they were breaking into fish camps.

Police said Moody was hit by a warning shot when three men confronted the group.

However, Dixon said the men would not be charged in the shooting.

Now the Byrd, Tyree and Parnell face felony murder charges for her death.

She also said two of the teens, Dylan Tyree and Daniel Parnell, tried to save their Moody’s life by rendering first aid.

Dixon said if found guilty of felony murder the teens could face 10 years to life in prison.
