Family of Bobby Wilson speaks out

SPANISH FORT, Ala. - The family of a murdered Spanish Fort man is speaking out. Bobby Wilson's daughter says she's not happy with the performance of Baldwin County District Attorney Judy Newcomb. However, Newcomb says the family's grief is causing their anger.

Business at Wilson's Service Station is steady. But all is not right with the family of Bobby Wilson.

Wilson was severely beaten inside his gas station in 2007. His accused killer, Eric Buzbee, was found not guilty in his third trial.

Wilson's daughter Tracy Goens says the district attorney, Judy Newcomb, didn't do enough.

"I know a lot of hard work went into this case. A lot of people put in a lot of hours and stuff, I thank them for what they did in the case. But I think mistakes were made. Things could have been different," said Goens.

Throughout all three trials, Newcomb's chief assistant Michael Pylant was the lead attorney.

During the first trial, Newcomb was absent because her daughter had a baby.

"I understand that, but she wasn't there for the second or third one. I feel like she abandoned us," said Goens.

"Do you have any second thoughts about going to see her?" asked FOX10 News reporter Hubert Tate.

"No, I don't have any second thoughts about going to see the birth of my grandchild," stated Newcomb.

Newcomb says she didn't prosecute the case personally, because her assistant is more than competent. She believes all the anger is coming from the family's devastation.

"I think it's just a symptom of their grief and I feel their pain. But I believe my office did a good job prosecuting this case," said Newcomb.

The DA says she did everything possible to get a conviction, and from day one, her staff was precise with the investigation.

"I don't look back at it with any regrets. We did the best we could in a difficult case. And the jury simply determined there was not sufficient evidence to meet the burden, which is a heavy burden beyond a reasonable doubt,"said Newcomb.

"I was disappointed with the way the case was presented to the jury. This is the end of the road for us. We can't do anything. This is it," said Goens.

However, one fact remains in this case. Bobby Wilson's killer is still free.
