Gravine Island adults identified

BALDWIN COUNTY, Ala. (WALA) - The Baldwin County Sheriff’s Office confirms William “Nick” Hearn of Semmes, Lonnie Davison of Theodore and Larry Dean Duncan Jr. of Mobile are the three adults involved in the shooting that took place on Gravine Island April 15.

Authorities said the specific details surrounding the incident that left 17-year-old Summer Moody fighting for her life after being shot in the head will not be released at this time.

According to her attorney, Moody has a one percent survival rate with the injuries she sustained.

Hearn’s attorney Tom Dasinger said although his client and the other two men present could face charges, he believes the three 17-year-old boys could also face new charges including felony murder if Moody succumbs to her injuries.  

“I think the kids, who are now charged as adults, could now be charged for felony murder out of it.  The felony murder statute is an unintentional murder that is committed in the course of another felony under the theory that the kids who were there were breaking into the camp houses,” Dasinger said.

Officials have not made any arrests for the shooting at this point.

Currently, investigators said they are not releasing specific details surrounding the incident as the investigation is still ongoing. But, they said they believe more information will be released in the near future.

The incident took place around 4 a.m Sunday. Deputies said Moody was on the island with three 17-year-old boys. Investigators said the boys are suspected of burglarizing a fish camp on Gravine Island Saturday night.

Officials said the men heard the teens, who were allegedly burglarizing fish camps, and opened fire.

In earlier statements, investigators have stated the men were taken into questioning, but released without being charged.

Meanwhile, the Baldwin County District Attorney's Office told FOX10 on Tuesday the three teens with Moody are being charged as adults with first degree burglary.

Baldwin County District Attorney Hallie Dixon released the following statement explaining the upgrade in charges:

“The charge of first-degree burglary includes the additional element of entering a dwelling with a weapon or dangerous instrument. Alabama law provides that young people older than age 16 who are charged with a Class A felony involving a deadly weapon must be charged as adults and tried in adult court.”

The teens' bond was set at $100,000 each. According to jail logs, Scott Tipton Byrd has been released on bond, and Daniel Parnell and Dillon Wade Tyree remain in jail.
