Gravine teen tells a different story

BAY MINETTE, Ala. (WALA) - Just one day after the announcement the three adults in the Gravine Island incident won’t be charged, the attorney for one of the teens said his client is saying investigators have it all wrong.

Scott Byrd was the boyfriend of Summer Moody , and his attorney Clark Stankoski said Byrd has a different story to tell.

District Attorney Hallie Dixon and Sheriff Hoss Mack gave a detailed description of what their investigation found, but Stankoski said his client was never given the chance to tell them his side.

Officials said they left no stone unturned.

"What our evidence shows is that Ms. Moody was hidden. She was hidden in a way that she literally could not have been seen. And the shot we believe struck her, struck her because the individuals involved fired away from the burglars," said Dixon on Thursday.

Stankoski said Byrd has a different picture of what happened that night. He wouldn't go into detail but said the three adults gave an inaccurate account.

"It is a complete different set of circumstances as to what these three men are saying," sais Stankoski.

Byrd was one of the three teens with Summer Moody the night she was shot .

Stankoski said that night, his client declined to make a statement without his attorney and hasn't gotten a chance since.

"Very early on in the investigation, I called the Baldwin County Sheriff’s deputy that has been investigating the case and told him we were willing to talk with him about the shooting but not the burglary. He told me he would get back with me, and I never heard from him," said Stankoski.

Dixon said they welcomed the statements.

"We have conveyed to attorneys that their clients are welcome to make statements and such statements would be considered. They were told that the first time they indicated their clients wanted to make statements, which was just the day before yesterday," said Dixon in a statement.

The three adults involved spoke to investigators on the scene.

"They have immediately took the side of these convicted felons and have chosen to not give the juveniles opportunity to tell their side of the story," said Stankoski.

Tom Dasinger represents William Hearn. He said the teens are trying to cover themselves, and their comments don't worry his client.

"After the fact, the kids want to come back tell their version but that just wasn't the case. They were there for illegitimate purposes vandalizing, burglarizing. They’ve got a lot more to hide," said Dasinger.

Byrd, along with Daniel Parnell and Dillon Tyree is charged as an adult with first degree burglary. Dixon said a grand jury will decide if they will be charged with felony murder as well.

"Hallie Dixon said it’s a tragic accident. I don't know how that’s murder and try to spin it to felony murder," said Stankoski.

Byrd is on house arrest and Stankoski said he's having trouble coping with the loss of Moody.

"He’s distraught over being charged with burglary, distraught immensely over loosing Summer, and he's distraught immensely over the possibility of going to trial facing these very serious charges," said Stankoski.

There will be a preliminary hearing for the burglary charges Thursday.

We are also expecting the grand jury to meet next week.
