Change of venue for Nodine trial?

Nodine's attorney files change of venue motion

BALDWIN COUNTY, Ala. (WALA) - For a second time , Steve Nodine is facing a murder trial in Baldwin County. However this time, it might not be in Baldwin County.

Nodine's defense team filed a motion this week asking Judge Charles Partin for a change of venue, citing too much media coverage of the case.

The defense team states in the document that the prosecution suggested Lee or Houston counties if the trial was to be moved. The defense said it had no objection to Lee County for the trial.

Also being discussed is the defense's claim of prosecutorial misconduct against former Baldwin County District Attorney Judy Newcomb. Nodine's defense team said the case against Nodine should be dismissed based on that allegation. The defense claims that Newcomb withheld evidence in the first trial. Nodine's defense team plans on using testimony from district attorney investigators in the hearing.

Nodine is currently living in the area, but is on electronic monitoring. Nodine's trial is expected to begin in August.
