Convicted felon arrested again

MOBILE, Ala. (WALA) - Two men released from jail early on a 2007 murder conviction didn't stay free for long. 

A traffic violation led to 22-year-old Raphael Landrum's latest arrest.

Police said, after running a stop sign, Landrum led officers on a chase that ended with his arrest on July 4.

In addition to the misdemeanor charges, Landrum now has a new felony charge.

"During the high speed chase, he ditched a gun out the window of the car," District Attorney Ashley Rich said.

Rich said Landrum's earlier conviction makes it a felony for him to carry a gun.

She said she didn't realize Landrum was in jail when police picked up Jarrod Poe Tuesday on rape and sodomy charges. 

Both Poe and Landrum were convicted in connection with the murder of Jimmie McGhee in 2007.

The third co-defendant from the murder case is also out of prison.  Records show Kastello Vaughan was later arrested in 2011 on a charge of receiving stolen property.

Landrum confessed to shooting McGhee, but he ended up with the same sentence as Poe, who agreed to a plea bargain with prosecutors. 

"The person who chose to take the plea bargain got a murder conviction, but he was not the shooter, and the shooter, the jury found guilty of a lesser included offense of manslaugther. So, the judge felt compelled to give him the same sentence," Rich said.

That meant both men only ended up serving 5 years of 20 year sentence.

The murder victim’s uncle said he didn't know the men were even out of jail. He said its unnerving, he feels the men should have been locked down for the crime.

"If anybody else committed murder they'd be locked down," Arthur Woods said.

The DA said she plans to do everything she can to keep them behind bars this time.

"We will ask the judge to fully revoke both of their probations," she said.

Both men were given a split 20 year sentence, and both served 5 years behind bars.

Poe was arrested and charged with rape and sodomy Tuesday after he allegedly assaulted a woman he knew while the two of them were in the woman's car.
