MOBILE, Ala. (WALA) - Mobile police re-arrested a man convicted of murder.
Jarod Allen Poe, 25, was arrested Tuesday morning for rape and sodomy first, a little more than a month after he was released from prison for his murder sentence.
Cpl. Chris Levy said he sexually assaulted a woman he knew in her car, while parked on Azalea Road.
FOX10 caught up with Mobile County DA Ashley Rich who said, “He (Poe) was released from the department of correction on June 3 of this year so he was out a little less than 40 days when he committed this new offense.”
Back in June of 2007 Poe was arrested and charged in the shooting death of Jimmie McGhee.
Rich, who was an assistant DA at the time, said Poe was with two other men during the shooting but didn't pull the trigger.
She said it was a drug deal gone bad.
The DA ultimately decided to strike a deal with Poe if he plead guilty.
“He was given that sentence because he agreed to testify against the shooter in that murder case. That is often the case - we have to offer a plea agreement because in a situation like that he's the only witness to the actual murder that happened,” said Rich.
Poe only served five of his 20 year sentence.
Now with this new arrest, Rich said she intends to tack on the rest of that murder sentence.
“We have a probation hold on him and we are going to ask the judge to send him back to Department of Corrections to serve the remainder of that 20 year sentence,” she said. “We will also pursue these new rape and sodomy charges on top of that.”
As for the actual shooter in that 2007 case, Rich said a jury convicted him of manslaughter and a judge decided to sentence him to the same prison time as Poe anyway.
Poe is expected in court Thursday on the new charges.
