MOBILE, Ala. (WALA) - One of the men accused of murder in the shooting death of Wendy Fisher in front of her home on Racine Ave. appeared before a judge for his preliminary hearing on Tuesday.

A grand jury will now decide the fate of the case against Pat Brown. Brown is charged with murder in the July 7 shooting incident.

Mobile Police believe Brown was the driver of the vehicle that Trayon Washington allegedly stepped out of before arguing with Fisher, who had yelled at the car to slow down. Washington is accused of shooting Fisher to death.

A Mobile police detective described the scene he saw on the evening of July 7. The detective told the court Pat Brown's phone records tell his location at the time of the crime.

The detective said there were four people in the vehicle when the incident happened.

Defense attorney Jason Darley said his client didn't fire the shot that killed Wendy Fisher.

"No one at the scene identifies Pat Brown, there's testimony from some of the co-defendants evidently that he's the driver of the car. No one says he ever got out of the car so at most he's the driver," Darley said.

The two people who police believe were in the back seat of the car have not been charged.

Darley said he has yet to see Brown's phone records. Police believe Trayon Washington was sitting in the front passenger side of the vehicle and believe he pulled the trigger. Darley said he's looking forward to conducting interviews of his own.

"In any case, you'll have witnesses in the vehicle, Trayon Washington, and a lot depends on what happens in their cases," said Darley.

. Fisher's parents were at the hearing.

'I feel like we lost our daughter and he was part of it, in the car. We just want justice," said Carol Fisher.

Brown's case was bound over to a grand jury.

Washington's murder case is also set to be heard by a grand jury. The two people reportedly in the back of the vehicle during the incident have not been charged.
