Grand Bay man dead following shootout

GRAND BAY, Ala. (WALA) - Authorities said a man is dead after being shot by another man on Tuesday night in Grand Bay.

Late Tuesday night, Mobile County Sheriff's deputies responded to Tom Waller Road and Waxton Road in Grand Bay for a report of a shooting.

The Mobile County Sheriff's Office said Terry Birdsong approached two men sitting outside a home in Grand Bay and produced a hand gun. One of the men, Seth Stallworth, pulled out his own gun, and fired shots while running into woods behind the house.

“It was a lot of people all around, both sides of the street. He was laying in the street, police had it taped off. I couldn't see who it was, and I couldn't get to him to verify if it was my husband.  When they put him in the ambulance, I saw his arm hang out the ambulance; and I saw his wedding band. And, I knew it was him,” said Myoshi Birdsong, wife of Terry Birdsong.

Sheriff's officials said  Birdsong died at Infirmary West Hospital. He was struck by two bullets.

“He wasn't moving. They rushed him to the hospital. I rushed behind. I got there and ten minutes later they said he past away. He'd been shot twice once in the neck and in the stomach,” said Birdsong.

“The Mobile County Sheriff's office said Seth Stallworth called 911 and reported that he shot a man, whom he says, pointed a gun at him.

Investigators said Stallworth pulled out his own gun and fired it toward Birdsong, while running away.

“I hate that it happened. I regret that he died, but I was minding my own business when he came around and tried to kill me,” said Stallworth.

Deputies later recovered Birdsong's loaded handgun.

Stallworth said he keeps replaying the event in his head and can't believe it happened.

“I couldn't get no sleep, of course I hate it had to happen. Never thought I'd kill someone,” said Stallworth.

Birdsong's wife said family members from out of state have been notified and plan to make funeral arrangements for him.

“My husband told me if anything ever happened to him he wanted to be shipped back to Shreveport, Louisiana, that's we he was born,” said Birdsong.

Stallworth's gun was in the front of his pants -- he said the event happened so fast that he couldn't remember taking out his gun

“I got custody of a 3-year-old. I was scared for my life and my cousins life,” said Stallworth, “Always think fast because I could've been dead in the road, and my son could've been growing up my himself.”

Officials said witness statements match Stallworth's account of the incident, and he has not been charged with any crime.

The Mobile County Sheriff's Office continues to investigate and plans to present this case to a grand jury.
