MOBILE, Alabama (WALA) - Felicia Lee, the mother of a suspect in the Kyser Miree murder, has once again been denied bond. The judge called Lee a danger to society.
Lee walked into Judge Sarah Stewart's courtroom Friday morning, in a third attempt to get bond, and for a third time, she was denied.
Her attorney, Sid Harrell, called it a miscarriage of justice.
"Routinely, murderers, rapist and kidnappers are given bond for a class A felony in this courtroom," said Harrell.
Lee is accused of intimidating a witness in her son Michael Lee's capital murder case, which is considered a class C felony. The charge normally comes with a pre-set bond.
Judge Stewart said the threat made was: "I'm going to kill you, shoot your house up and kill your kids."
Harrell asked Judge Stewart to consider electronic monitoring, which the prosecution opposed.
"Electronic monitoring, if she violated that and carried out the threat, it would be too late to enforce something after it is done," said Assistant District Attorney Jill Phillips.
Lee is accused of telling a key witness in the Kyser Miree murder case she would kill them.
Phillips called Lee, 'The mother of the leader of this attack on Kyser Miree.'
Lee's family didn't want to talk about the allegation.
Harrell questions the credibility of the key witness, whom Lee is accused of harassing. He said there are two sides to every story.
"You have a lady here who is 40-years-old, virtually no criminal record against someone who I believe does have a criminal record, along with her husband and some sort of backroom deal made about what they know about the murder case," said Harrell.
Harrell added the alleged victim in the intimidation case was pulled over in Saraland, and to get out of being arrested, provided information to authorities.
"She got pulled over and said, 'Don't arrest me, I can tell you everything I know in the Kyser Miree murder case,'" said Harrell.
The state said since Lee has been behind bars, the threats have stopped.
In 1987, Felicia Lee was charged with criminal trespassing and harassing phone calls.
She will be back in court September 9 for a preliminary hearing.
