Motions filed for Mary G. Montgomery teacher facing sex charges

MOBILE, Ala. (WALA) - A Mary G. Montgomery teacher did not appear in court with her attorney today while her attorney filed motions in her case.

Nothing about the Alicia Gray case was discussed in open court. Instead, her attorney asked to approach Judge Jay York at the bench. This is what she said afterward.

"We held that motion hearing on some formal discovery type issues. I will have an order out shortly, Part of the process we're involved in, in the ongoing investigation, is that everyone has to be fully informed that is involved in the case," said defense attorney Christine Hernandez.

FOX10 News learned that Hernandez asked that the Mobile County District Attorney's Office preserve an audio tape of an interview with a witness as well as school video.

Mobile County Sheriff's Deputies said Gray's victim is a 14-year-old MGM student.

The high school teacher was charged with two counts of sodomy, one count of sex abuse, and one count of sexual contact by a school employee with a student under the age of 19 after allegations of the inappropriate relationship surfaced in February.

"Everyone should remember that in this country you are innocent until proven guilty beyond a reasonable doubt and we're waiting on process," Hernandez said.

Gray surrendered on February 25, with her attorney and husband by her side. Fox10 News obtained the search warrant affidavit issued for Gray's property before the document was sealed. In the document it said Gray and the 14-year-old student met in several places including Mary G. Montgomery High School and engaged in sexual activity.

A preliminary hearing for the case has been set for April 12.
