Search warrant, affidavit against MGM teacher released

MOBILE, Ala. (WALA) - FOX10 News obtained the search warrant and affidavit against the Mary G. Montgomery teacher accused of having a sexual relationship with a 14-year-old student.

The documents reveal some explicit claims against 28-year-old Alicia Gray, including that the teacher and student had inappropriate contact at the school.

The document states the victim and MGM school leaders were interviewed.

According to the documents, the teen told authorities details of activity he claims he had with the teacher, including where and how it happened.

Before Gray turned into herself into authorities on February 25, investigators said they asked questions and collected data.

The search warrant affidavit said the teen told authorities the relationship with Gray began in January with inappropriate contact between the two over Facebook, cell phones and computers.

The document states the 14-year-old told investigators the two engaged in physical contact which consisted of "kissing and hugging during and after school hours while at Mary G. Montgomery High School."

Gray's Attorney Christine Hernandez said the allegations in the document does not mean Gray is guilty.

"An arrest is simply a way to start the judicial process," Hernandez said.

The affidavit also said the alleged victim told authorities sexual contact between the two eventually intensified, reporting allegations that it resulted in Gray touching the teen on his private parts and performing sexual acts on him.

The document also states the alleged victim told authorities he performed sexual acts on Gray on more than one occasion.

The affidavit also states the teen described the teacher's private parts to authorities.

A judge ordered the Crime Scene Identification unit to take photographs of the teacher, from the waist down to test those allegations.

According to the affidavit, copies of the photographs are to be provided to both the state and the defense.

Hernandez responded to the documents claims.

“What I want the public to understand and what I want everyone else to understand as well is that this: that in this country, you're innocent unless you are proven guilty beyond a reasonable doubt,” Hernandez said.

The teen’s attorney David Greene weighed in on the case.

"This young man is a victim of an adult who took advantage of him being a child, and it’s as simple as that,” Greene said.

Greene also responded to the claim that the 14-year-old participated in sexual activity with the teacher. He said it's still illegal.

"The law in the State of Alabama is he is a minor. He is not capable of making that decision a person in authority that caused him to be involved in that type of act or acts whatever happened.  It's violation of the law,” he said.

FOX10 asked for a comment from the Mobile County School System about the claim that some of the alleged sexual activity happened on campus, during and after school hours.

It said it cannot comment on the investigation, but it takes these types of allegations seriously.
