Wendy Fisher's accused shooter waives preliminary hearing

MOBILE, Ala. (WALA) - The attorney for the teen charged with Wendy Fisher's murder waived the suspect's right to a preliminary hearing as well as his right to appear in court on Monday.

Trayon Washington's case will now go before a grand jury. If the grand jury hands down an indictment, the court process will continue.

Washington is charged with murder. His lawyer, Art Powell, entered a not guilty plea for the teen on July 23.He said his client is convinced of his innocence.

“He's fine. He maintains his innocence, says he didn't do it,” said Powell. “He didn't do it.”

Powell said he believes a preliminary hearing would be a repeat of the details that had already come from the police department. He said he believed the case was going to a grand jury anyway so he says was there was no benefit for his client to appear in court or to proceed with a hearing.

The suspect’s attorney said, based on what he heard, the testimony was going to be from the Mobile homicide department.

Meanwhile, the District Attorney's Office says a capital murder charge is not off the table for the 18-year-old suspect. Assistant District Attorney Jennifer Wright says it all depends on where the suspect was standing when he allegedly shot Fisher.

“That would be the one element that would possibly make this capital, if he was shooting from within the vehicle,” said Wright. “There have been some conflicting statements as to whether his placement was inside or outside the vehicle.”

Wendy Fisher’s family appeared in court Monday . Her mother, Carol Fisher is optimistic about the future of this case.

"We need to trust our justice system. The judges, the police officers, the detectives… we need to put our trust in them and allow them to be who they are supposed to be and that is the people who take care of us and bring justice,” said Fisher.

Authorities arrested then 17-year-old Trayon Washington for Fisher's murder on July 11.

Fisher, 40, was shot to death on Racine Avenue on July 7. They say she was yelling at a speeding car to slow down before she was shot.
