ROBERTSDALE, Alabama (WALA) - Thursday evening, Angel Downs' family said their loved one was the victim of murder. Friday afternoon, Baldwin County District Attorney Judy Newcomb agreed, and she said there's only one suspect so far, and that's Steve Nodine.

"The evidence at this time indicates that Mr. Nodine was in the area at the time Angel Downs died. And the evidence at this time appears to be overwhelming that she did not intentionally take her own life," Newcomb said.

Nodine does not currently face murder charges. However, the investigation is ongoing.

Just 24 hours ago, the Newcomb said Downs' case was a death investigation, not a murder investigation. So what changed?

"The forensic experts have now examined her body for a second time, getting evidence. We've re-examined her body. We have the most qualified cell tower, cell phone experts scouring these records and developing maps on that. We have gun experts reviewing the gun," Newcomb explained.

Newcomb also said Nodine's behavior since Sunday night, which includes allegedly changing clothes and acting "aloof" in front of investigators, has factored into the case.

"All of his actions affect our decision," Newcomb said.

Newcomb said the state plans to present a case on Nodine to a grand jury May 24.
