DAPHNE, Ala. (WALA) - Former Spanish Fort football standout and Alabama commitment Deon Johnson is still in the Baldwin County Jail and will likely stay there while he awaits a trial date on rape charges. In a new development, a Baldwin County Grand Jury has indicted Johnson on three counts of rape. FOX10 has learned that the third alleged victim filed a complaint with Spanish Ft. Police.
"There were some witnesses, not a direct witness… an eye witness, but some witnesses to corroborate her story," said Spanish Ft. Police Chief David Edgar.
Spanish Fort Police said the alleged rape happened inside a restroom at a public park.
Daphne Police originally arrested Johnson in September 2012 on second degree rape and second degree sodomy charges after he allegedly sexually assaulted a juvenile.
He bonded out, but Daphne later arrested him on a first degree rape charge after a second victim came forward. He made bail again, but had it revoked in February 2013 after the Baldwin County District Attorney's Office said that he'd been in violation of his bond conditions.
The DA's Office said Johnson was acquainted with all three of the juveniles he's accused of raping and it's been a delicate process getting them to come forward.
"It's not something that they want out there. It's not something that they want public and frequently when they see other people that are brave enough to stand up and say this happened to me, they feel more comfortable coming forward," explained Assistant DA Theresa Heinz.
Heinz said she's ready to move forward as Johnson's arraignment approaches. She said her focus will remain protecting the rights of victims.
"As always, my goal in any kind of sexual assault is to try to resolve them without putting my victim through trial, but I'm more than willing and more than ready to go to trial if need be," Heinz said.
Heinz said she hasn't decided yet if she will try each rape case individually or consolidate them. Deon Johnson's arraignment is scheduled for May 22.
