BAY MINETTE, Ala. (WALA) - TEENS HEADED TO COURT
Scott Byrd, Dillon Tyree and Daniel Parnell, all 17, are headed to court Thursday morning. All have been charged with first-degree burglary. Baldwin County Sheriffs said the boys were breaking into a fish camp on Gravine Island early on the morning of April 15.
Summer Moody was with the boys on the island when she was shot in the head by campers . She later died from her injuries.
Because of Moody's death, it's possible the juvenile's charges could be upgraded; but that has yet to happen.
Byrd's attorney Clark Stankosk spoke to us about the case Wednesday afternoon.
He said, "I can envision the hearing just being about the burglary first which has nothing to do with the shooting. And since there haven't been any additional charges, then all we're doing tomorrow is going on the burglary first."
PROBABLE EVIDENCE PRESENTED DURING PRELIMARY HEARING
Baldwin County District Attorney Hallie Dixon didn't speak before the hearing, but generally during a preliminary hearing a lot of new information comes out. In a case like this, that can go a long way to answering some questions.
Stankoski is confident and said the defense is ready.
He told us, "We've looked at pictures that ya'll have put on the news and in the newspaper and this appears to be a cabin that was not broken into. So the state is going to have to prove by some kind of evidence tomorrow under oath that they broke into that cabin, and that they were armed when they did it. And as of this point, I don't know how they're going to do that."
