MOBILE, Ala. (WALA) - A man accused of shooting into a crowded Tillman’s Corner fast-food restaurant will be re-arrested and charged with two counts of attempted murder, according to the Mobile County District Attorney's Office.
Less than 24-hours after being profiled on FOX10, authorities said they will be upgrading charges against Darrin Gaddis, 23.
“When you get a loaded weapon that has 18 rounds in it and you decide to use that weapon in a public place where people are, then you have intent to kill someone,” said Mobile County District Attorney Ashley Rich.
FOX10 spoke with Gaddis when he was released from jail only 4 hours after his arrest Tuesday September, 17.
Gaddis was initially only charged with second-degree assault and discharging a gun into an occupied building.
Investigators said Gaddis unloaded his gun outside the McDonald’s Restaurant in Tillman’s Corner after a dispute with two brothers.
FOX10 spoke with the two men, who did not want to be identified.
They said Gaddis and several people in his car began cursing and name-calling some of his family members in the parking lot, behaving in a ‘drunken’ aggressive manner.
“They said they were leaving and that they'd be right back,” said one man who claims he was confronted by Gaddis. “We went inside to get something to eat and I saw them pull up again. I walked outside and they opened fire.”
The man’s brother, who was inside the restaurant said. “I walked by the door to check on my brother and the glass got blown out and next thing I know I’m shot. I mean that was just stupid over an argument. A little kid could have gotten killed.”
Jeff Brown was in the restaurant with his wife and 5 of their children when the shooting happened.
He said he was trying to rescue his 7-year-old son when a bullet grazed his leather belt.
District Attorney Ashley Rich said although Gaddis claims he had no intention of shooting anyone, he was reckless.
Gaddis maintains he opened fire after one of the men pulled a weapon on him for confronting the group.
“This could have been anybody in that McDonald’s! It’s inexcusable conduct in my opinion and so we have these charges of attempted murder,” Rich said.
