BAY MINETTE, Ala. - Briana Parish's family made their presence known in court todayby wearing shirts in her memory. "This is mainly to help makepeople aware that young women know they should not be out alone,"said Dee McClantoc, a Parish relative. "We don't want this tohappen to anyone else."
Troy Macdonald's defense team acknowledged that Daphne Policehave surveillance video of Macdonald leaving the Bayhouse Pub. Buthis attorney attempted to show that the state has no way to proveParish was inside Macdonald's car at the time.
Clark Stankoski says the case is far from over. " We aregoing to get all the evidence the state is getting. They arelooking at videos other than what they talked about," saidStankoski.
On the other side of the courtroom, the District Attorney'soffice called a Daphne police investigator to the stand. Hetestified that Macdonald had been drinking that night and toldsomeone he wanted to quote "hook up with her."
The judge then ruled the case will proceed. "His case will bepresented to the February grand jury. And they will be the actingbody to decide the charges he will face as to go on through theprocess," said the District Attorney.
During the proceeding, Troy Macdonald was very emotional, evencrying during testimony. However, he was taken back tojail.
Family members say this is one step closer to justice. "We havea lot of God with us, so that's where out strength is."
FOX10 News learned Thursday that Brianna Parish was naked fromwaist down when she was found. Detectives say they were also ableto match semen found in Parish's body to Troy Macdonald.
