Federal judge sets plea for Elberta school shooter

BALDWIN COUNTY, AL (WALA) -

A federal judge sets a not guilty plea in the case of Barbara Grice, 52, the Foley woman accused of firing a gun inside Elerta Elementary School.

Grice was indicted by a federal jury in March. Investigators say she attempted to kill her sister.

She was indicted on possession of a firearm on school grounds and discharging a firearm on school grounds for the February incident where investigators say she brought a revolver inside the school cafeteria.

She entered court on Monday in a wheel chair, her medical condition is unclear.

Grice's attorney John Beck filed a motion for Grice to undergo a mental evaluation. He says he has grave concerns about his clients mental condition.

The U.S. Attorney's Office did not have an issue with the motion.

The judge set a not guilty plea until the evaluation is complete. Beck says he filed the motion because his clients history of behavior.

"I'm interested in the evidence and I'm also interested in my clients well-being. I was able to get a disc of evidence today which we will have opportunity to review," Beck said.

Grice remains in the Baldwin County Jail, on a $1 million bond.
