"The victim's son kept begging." Witness describes deadly road rage shooting on I-10

MOBILE, AL (WALA) -

A case of road rage turned deadly on I-10 Sunday night. Mobile Police are identifying the victim as 42-year-old Timothy Pinckard. 

Witnesses say the victim's son saw it all. The shooter hasn't been charged.

Cars pulled over on I-10 East around 5:00 Sunday night, had many thinking it was just a fender bender. As an owner of a tow truck company, Jason Franklin, who didn't want to show his face, pulled over to help.

"That's when I started hearing people hollering, he's got a gun, he's got a gun."

Then he heard gun shots. Franklin says he saw Pinckard fall to the ground, while his son cried for help in the truck. 

"The victim's son, kept begging, to let him check on his dad, he said please let me check on my dad, you shot him, let me check on my dad."

Police say Pinckard and another man got into an argument while driving east on I-10 near the Riviere Du Chien road overpass. 

"I heard yelling but I couldn't make out what it was...cussing [them] out, talking about how he was going to shoot them."

A witness snapped a picture passing by. You can see a man standing up; witnesses say he's holding a gun. That's the man we're told got out of a Toyota Highlander parked in front of the truck. Witnesses say Pinckard barely got out of his truck, before he was shot multiple times. Franklin says police got there minutes later. Before that though, Franklin says the shooter pointed the gun at him. 

"They demanded him to drop the gun, he dropped the gun, they took him down by force...I've worked a lot of fatalities...none like that."

Another witness, Alison Roberson, tells FOX10 News: "As I walked up and got closer, I saw a kid on the ground and the shooter had the gun over him and wasn't letting him up...He [the victim's son] was just screaming 'how could you? He was all I had left'. And he was begging my friend to please pull him out of the car and try CPR, but 911 advised me to tell him 'no' because at this point it was a murder scene."

No word yet on what started the argument.

Charlette Solis with the Mobile Police Department said, "The case will be presented to the Mobile County Grand Jury for further prosecutorial efforts." 

Mobile Police said they are investigating this case as a homicide.

Until the grand jury decision comes back, we won't know if there are any charges. Police have not identified the shooter.
