MOBILE, Ala. (WALA) - A man charged with fatally shooting a woman in front of her children now faces a capital murder charge.

A Mobile County grand jury upgraded the charges against Milton Lamar Farris, 38, of Mobile. He also faces charges of robbery, kidnapping, receiving a stolen firearm and raping a child.

Police apprehended Farris in August 2023 in the 2000 block of Bragdon Avenue with the assistance of the U.S. Marshals Service Gulf Coast Reginal Task Force. Police had been searching for him since finding 30-year-old Malinda Robertson dead outside her home on Wagner Street in the Toulminville community.

Police originally believed the gunman might still be inside. They did not find him but did discover Robertson’s four children.

As police led Farris to a vehicle to take him to Mobile County Metro Jail, Farris expressed contrition.

“If I could take all this back, I wish I would. … I wish I could take it back, man,” he said at the time.

Prosecutors have not determined whether they will seek the death penalty against Farris. He has an arraignment set for Sept. 25.
